About the law

What Colorado SB21-169 requires.

Colorado SB21-169 prohibits insurers from using external consumer data and information sources (ECDIS), and algorithms and predictive models that rely on ECDIS, in a way that unfairly discriminates based on race, color, national or ethnic origin, religion, sex, sexual orientation, disability, gender identity or gender expression.

01

Testing for unfair discrimination

Assess models and the external data they rely on for outcomes that unfairly discriminate against protected groups.

02

Governance and risk management

Put a documented framework in place to govern how ECDIS, algorithms and predictive models are used.

03

Accountability and evidence

Keep a traceable record of tests, results and decisions, ready for the regulator.
